Terms & Conditions
The following Booking Conditions together with our General Information available at SailCR.com form the basis of your contract. All bookings are subject to these booking conditions. The parties to that contract are yourself and B E Cruises LLC Ltda. of Bahia Ballena, Osa, Puntarenas, Costa Rica, who shall accept legal responsibility for the proper performance of this contract as set out below. In these booking conditions, ‘you’ and ‘your’ means all persons named on a booking and ‘we’, ‘us’ and ‘ourselves’ means B E Cruises LLC Ltda., registered in Costa Rica with the identification number 3-102-810014.
Partial or full payment of your cruise constitutes acceptance of the below terms and conditions. These Booking Conditions are subject to change without notice
1. Pricing
Prices of our services on our website are in US Dollars (USD) and are subject to the local Costa Rican IVA of 13%. The prices will be charged in US Dollars (USD). In our office, you may pay either in cash or with a credit card in US Dollars (USD) or Costa Rican Colones (CRC). Credit Card surcharges from your credit card company may apply, rates of the foreign exchange at the time may vary.
Prices are subject to change without notice and liability.
2. Confirmed booking
Day Cruises: The full amount is due at the time of booking.
Special Events: For special events and private cruises, a 30% deposit will be charged to secure the date(s).
3. Convenience fees
A 3.5% fee applies to all credit card payments
4. Booking date changes
In case you want to change your booked date, we will try to accommodate your wishes. However, this depends on the availability and we cannot guarantee to be able to change your booking.
5. Booking name changes
Name changes are permitted free of charge at any time.
6. Cancellations & no-shows
For cancellations received, the following cancellations charges will apply:
For Day Cruises: Should your plans change a full refund can be provided up to 24 hours before departure.
For Multi-Day Cruises: Up to 30 days before departure a full refund will be provided. We are unable to refund any part of the payment less 30 days prior to departure.
For cancellations due to Government restrictions, B E Cruises LLC Ltda. will be offering 100% credit on payments made. Credit will be valid for 12 months from your original booking date and to be used towards a shared cruise at a later date.
No refunds for no-shows or if you miss the boat. It remains the responsibility of the client to ensure they are at the designated marina on time.
7. Wet weather
Cruises will go out in wet weather. The boat has enough covered seating areas. No refunds/transfers for cancellations due to poor weather unless B E Cruises LLC Ltda. is forced to cancel for safety reasons.
8. Transport to or from the pick-up location
Local transportation at specified pick-up locations is included if requested during booking. If a guest is missing the shuttle to or from the marina, B E Cruises is not liable for missing the cruise, or extra costs for transportation.
9. Delays
B E Cruises LLC Ltda. prides itself on offering timely service. In case of unexpected delays due to mechanical, operational reasons, or otherwise unforeseen circumstances, B E Cruises LLC Ltda. holds no liability.
10. Damages
All breakages & damages must be paid for.
11. Minimum numbers
Minimum numbers apply to our shared cruises and we reserve the right to cancel or amend our services. Where this happens you will be offered the opportunity to reschedule or receive a refund. We shall not be liable for additional travel or accommodation expenses.
12. Optional upgrades
Optional upgrades including meals and bar packages, or any other upgrades that are not otherwise included in a cruise package must be booked in advance and are subject to availability.
13. Shared tables
Whilst all measures are taken to try and ensure the comfort of our passengers, please note that tables are shared with other guests.
14. Authorized vendors
Cruises may be booked via your hotel concierge, authorized partners, agents, or directly through B E Cruises LLC Ltda. either via our website (www.sailcr.com) or telephone/Whatsapp on +506 6037 1111 and +506 6177 7714. When booking through a third-party vendor, you do so in agreement with their terms and conditions and in conjunction with the terms and conditions listed here accordingly. All claims, booking changes, and cancellations must be taken up directly with your vendor.
15. Disclaimer
B E Cruises LLC Ltda. reserves the right to a) change any price b) amend or cancel any service, route, or other information without notice and without incurring liability if required
16. Onboard photography
Passengers may be filmed/photographed during the cruise. B E Cruises LLC Ltda. reserves the right to use or reproduce such film or material for promotional purposes without notification, compensation, or payment.
17. Injury
To the extent permitted by law, the Company, employees, and agents shall not be liable for any claims, losses, damages, injuries, costs, and expenses suffered, sustained, or incurred (including but not limited to indirect or consequential) as a result of, or arising out of, or in any way connected with the cruise.
The Passenger releases the B E Cruises LLC Ltda. for any claim whatsoever and howsoever incurred including but not limited to a claim for death bodily injury damage or loss of property during embarkation and/or disembarkation to or from the vessel and/or at all times whilst on board the vessel itself unless caused by willful misconduct or reckless disregard of the Company. Whilst B E Cruises LLC Ltda. ensures a safe environment for all guests traveling on board our ship, we accept no liability for any injury or claim caused by the passengers own negligence including, but not limited to, tripping, falling, or any other accident that could be avoided by taking due care and caution of one’s surroundings. Equally, should any guest choose to disregard on board safety rules and regulations or advice from our crew on board, then B E Cruises LLC Ltda. shall be free from liability for any claim or injury incurred as a result. Due to the sometimes unpredictable movements of the vessel(s), sensible/ flat footwear is highly recommended whilst on board.
Privacy Policy
For the purposes of Regulation (EU) 2016/679 of the European Parliament and of the council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), and any associated legislation, B E Cruises LLC Ltda. is a Data Controller. In order to process your booking, we need to collect certain personal details from you. These details will include, where applicable, the names and addresses of party members, credit/debit card or other payment details and special requirements; such as those relating to any disability or medical condition, which may affect the chosen vacation arrangements, dietary restrictions, and religious beliefs which you may disclose to us. We may also need to collect other personal details such as your nationality, citizenship, gender, and passport details in addition to the details mentioned above. If we need any other personal details, we will inform you before we obtain them from you. We need to pass on your personal details to the companies and organizations that need to know them so that your vacation can be provided (for example your airline, hotel, the ship operator, other suppliers, credit/debit card company or bank). We may also be required, either by law or by applicable third parties (such as Immigration Authorities) to disclose your details for various reasons; for example in the interests of protecting national security. Such disclosure of personal details will only be made if permitted by the Data Protection Act 2018 or General Data Protection Regulation (as applicable) and any associated legislation. We would also like to store and use your personal details for future marketing purposes, (for example sending you a brochure or details of a promotion). All details you give us in connection with your booking (including those relating to any disability or medical condition or your religious beliefs) will be kept confidential. However, we will use only names and contact details for marketing purposes. You can write to the B E Cruises LLC Ltda. info@sailcr.com if you wish to not receive marketing and promotional material from us. We are entitled to assume you do not object to our doing any of the things mentioned in this statement unless you tell us otherwise in writing. Except where expressly permitted by the Data Protection Act 1998 or the General Data Protection Regulation (as applicable) and any associated legislation, we will only deal with the personal details you give us as set out above unless you agree otherwise. We have appropriate security measures in place to protect this information. You are generally entitled to ask us (by letter or e-mail) what details of yours are being held or processed, for what purpose, and to whom they may be or have been disclosed. We promise to respond in most cases to your request within a month of receiving your written request. In certain limited circumstances, we are entitled to refuse your request. If you believe that any of your personal details, which we are processing, are inaccurate or incorrect please contact us immediately.
